Two Mountains Burial Services (PTY) LTD – Terms and Conditions for Old Mutual Customers

The burial services we provide to you are subject to Two Mountains Burial Services (Pty) Ltd’s Terms and Conditions for Old Mutual Customers, which are set out below. Please read the Terms and Conditions carefully.

They include important terms that limit our responsibility to you and set out your responsibility to pay any amount above your cover amount – please see clause 7 (how the service is paid for) and clause 10 (our responsibility to you) in particular.

By accepting this invoice, you confirm that these terms were brought to your attention and that you agree to them.

In Summary:

  • As an Old Mutual customer, you receive a preferential discount on our burial services that members of the public who pay cash do not receive.
  • You never have to use the burial service. You may always choose to receive the full cover amount under your Old Mutual policy in cash instead (see clause 7).
  • Two Mountains provides the burial service. Old Mutual is responsible for your policy and pays for the service from your cover amount.
  • Our prices and this offer are current and may change on reasonable notice.

Please read clause 7 (how the service is paid for) and clause 10 (our responsibility to you) with particular care – they affect your rights.

1. Introduction and How These Terms Apply

1.1. We are Two Mountains Burial Services (Pty) Ltd (Registration No. 2012/119760/07) (“Two Mountains”, “we”, “us” or “our”), a registered funeral services provider and a member of the Old Mutual group.

1.2. These terms apply to the burial service we provide to you when you, as an Old Mutual customer, take up our preferential burial offer. They form the agreement between you and us for that burial service.

1.3. By instructing us to provide the burial service, or by accepting our services – for example, by signing or accepting the service confirmation or invoice – you agree to these terms. We will draw these terms to your attention on the service confirmation or invoice and provide you with a copy.

1.4. These terms govern the burial service only. Your funeral policy is a separate agreement between you and Old Mutual. Old Mutual is responsible for your policy, for confirming your cover and for assessing and paying the claim; we are responsible for the burial service.

1.5. We have tried to write these terms in plain language. If anything is unclear, please ask your Two Mountains consultant before you instruct us to proceed with the burial service.

2. What Some Words Mean

2.1. “Old Mutual” means Old Mutual Life Assurance Company (South Africa) Limited.

2.2. “Old Mutual customer” means a holder of, or an insured person, beneficiary or eligible person under, an Old Mutual funeral policy that includes the burial service option.

2.3. “Qualifying customer” means an OMLACSA Customer who is eligible for the preferential burial offer (see clause 3).

2.4. “Cover amount” means the amount payable under your Old Mutual policy.

2.5. “Preferential burial offer” or “the offer” means the preferential pricing and related benefits described in clauses 4 and 6.

2.6. “Partner parlour” means an independent funeral parlour that we have accredited and contracted to help provide services in areas where we do not have our own branch.

3. Who Qualifies for the Offer

3.1. The offer is available to Old Mutual customers who take up the burial service option under their policy and who meet the qualifying requirements in this clause 3.

3.2. Whether you qualify, and whether your policy is in force, is determined by reference to Old Mutual’s policy records and rules. If you have any question about whether you qualify, or about the status of your policy, please contact Old Mutual.

3.3. The offer applies to Old Mutual policies that have been in force for a continuous period of at least 12 (twelve) months (that is, on or after the first policy anniversary), as reflected in Old Mutual’s policy records.

4. The Preferential Discount

4.1. As an Old Mutual customer, you receive a discount of up to a maximum of 25% on our burial service packages – a discount not available to members of the public who pay cash.

4.2. The discounts may change on reasonable notice (see clause 11). The actual cost of your chosen package, and the rand value of your discount, will be shown on your itemised invoice.

5. Pricing, VAT and your Invoice

5.1. You will receive a detailed, itemised invoice showing the services you have selected, their cost, the discount applied and the amount payable.

5.2. Prices include VAT unless we state otherwise.

5.3. Our prices are current and may change. The price that applies to you is the price on your invoice at the time you instruct us to proceed with the burial service.

6. Value-Added and Additional Services

6.1. The following value-added services are offered as part of the offer: a digital funeral notice, a condolences book, collection and delivery within 0–50km, and assistance with lodging your claim with Old Mutual.

6.2. Tombstone discount: where you also purchase a tombstone, you may qualify for a discount of up to R20 000.00 on the tombstone price, depending on factors such as the tombstone selected, its value, or the package you choose. The discount applicable to you will be shown on your invoice.

7. How the Service is Paid for

7.1. Where you elect the burial service option and Old Mutual admits a valid claim under your policy, the burial service is funded from the cover amount payable under that policy.

7.2. If the cost of the burial service (after your preferential discount) is less than the cover amount, Old Mutual pays the balance to you or the beneficiary.

7.3. If the cost of the burial service is more than the cover amount, you are responsible for paying the difference directly to Two Mountains.

7.4. You do not have to use the burial service. You may always choose to decline it and instead receive the full cover amount in cash from Old Mutual, in accordance with your policy.

8. How and Where we Provide the Service

8.1. We provide burial services within the Republic of South Africa only.

8.2. We provide services through our own parlours and, in areas where we do not have a branch nearby, through approved partner parlours. Where a partner parlour assists – for example, with the initial collection and temporary storage of the deceased – we remain responsible to you for the burial service.

9. Your Personal Information

9.1. We process your personal information to provide the burial service, in accordance with the Protection of Personal Information Act, 2013 and our privacy notice.

9.2. We share your information with Old Mutual to the extent needed to confirm your cover and process the claim, and with partner parlours to the extent needed to provide the service. We keep it secure and use it only for these purposes.

10. Our Responsibility to You

10.1. We will provide the burial service with reasonable care and skill, and in line with generally accepted standards in the funeral services industry.

10.2. Nothing in these terms excludes or limits any right you have under the Consumer Protection Act, 2008, or any liability that cannot lawfully be excluded or limited.

10.3. Subject to clause 10.2, and to the extent the law allows, we are not responsible for loss or damage that was not reasonably foreseeable, or that arises from causes beyond our reasonable control; and where we are responsible, our responsibility is limited to re-performing the affected service or making a fair and reasonable adjustment.

10.4. We are responsible for the burial service. Old Mutual is responsible for your policy and for assessing and paying the claim. Please direct any query about your policy, your cover or your claim to Old Mutual.

11. Changes to these Terms and the Offer

11.1. We may change these terms, the offer and our prices from time to time. We will give reasonable notice before reducing or withdrawing the offer; any change that is more favourable to you may take effect immediately.

11.2. The version of these terms that applies is the version in force when you instruct us or accept our services.

12. General

12.1. These terms are governed by the law of the Republic of South Africa, and the burial service is provided in South Africa only.

12.2. If any part of these terms is found to be invalid or unenforceable, the rest of the terms continue to apply.

12.3. These terms, together with your service confirmation and invoice, set out the agreement between you and us for the burial service.

13. Queries and Complaints

13.1. If you have any query or complaint about the burial service, please contact your Two Mountains consultant or the Two Mountains branch handling the funeral. We will attend to your complaint promptly and do our best to resolve it.

13.2. If your query or complaint relates to your Old Mutual policy, your cover, or the assessment or payment of your claim, please contact Old Mutual.
